Purpose of This Policy

Ravalli Broadband aims to provide its customers with reliable and high-quality broadband internet services. To support this goal, Ravalli Broadband has implemented this Acceptable Use Policy (AUP), which outlines acceptable uses of the Ravalli Broadband Internet service ("Service"). This policy is supplemental to the Ravalli Broadband Terms of Service.

Your Obligations Under This Policy

This AUP applies to all Ravalli Broadband customers and users of the Service. By using the Service, you agree to comply with this policy. Failure to do so may result in suspension or termination of your account. If you do not agree to this policy, you must immediately stop using the Service and notify Ravalli Broadband to close your account.

Policy Updates and Reporting Violations

Ravalli Broadband may revise this AUP periodically. The latest version will be available on our website at https://www.ravallibroadband.net. Customers are encouraged to review the policy regularly. Ravalli Broadband may notify customers of changes through email, website updates, or other means. Revised versions are effective immediately upon posting.

Prohibited Uses

Ravalli Broadband prohibits any use of the Service that is illegal, infringes the rights of others, or interferes with the operation of the Service. Examples of prohibited activities include, but are not limited to:

Conduct and Information Restrictions

  • Using the Service to post, store, or transmit any content that is illegal, defamatory, obscene, or infringes on intellectual property rights.

  • Sending spam, bulk messages, or unsolicited commercial communications.

  • Impersonating others, engaging in phishing, or forging digital signatures.

  • Distributing malicious software or engaging in unauthorized data collection, such as spidering or harvesting email addresses.

Technical Restrictions

  • Attempting to breach or circumvent the security of any network, system, or account.

  • Using tools designed to compromise security, such as password crackers or packet sniffers.

  • Operating unauthorized public-facing servers (e.g., email, file sharing, or web hosting) on residential Service plans.

  • Tampering with or modifying Ravalli Broadband-provided equipment or Service without authorization.

Network and Usage Restrictions

  • Interfering with or degrading the performance of the Service for other users, including through excessive data consumption or denial-of-service attacks.

  • Sharing the Service beyond your Premises LAN (e.g., through Wi-Fi hotspots) without prior authorization.

  • Using the Service with non-dynamic IP configurations unless specifically allowed by your Service plan.

Customer Responsibilities

As a customer, you are responsible for all activity on your account. This includes ensuring that anyone using your Service complies with this AUP. You must safeguard your login credentials and protect your equipment and devices from external threats, such as viruses or unauthorized access.

Ravalli Broadband strongly recommends securing any shared devices (e.g., file or printer sharing) with strong passwords and following manufacturer security guidelines.

Content and Transmission Management

Ravalli Broadband reserves the right to block or remove content that violates this policy or disrupts the network. While Ravalli Broadband does not routinely monitor transmissions, we may do so to address violations or protect the network. Ravalli Broadband may disclose, block, or remove content as required by law or to enforce this policy.

Electronic Communications

Customers must not use the Service to send emails or other communications that violate this policy. Ravalli Broadband is not responsible for lost, misdirected, or deleted communications. If a customer account is terminated, associated communications may also be permanently deleted.

Network Management

Ravalli Broadband employs network management tools to ensure fair use and optimal performance for all customers. Examples of these tools include:

  • Identifying and mitigating spam or malicious traffic.

  • Managing network congestion by prioritizing traffic during peak usage.

  • Monitoring data consumption to ensure compliance with Service plans.

Customers may be required to upgrade to a higher-tier Service plan if their usage exceeds reasonable levels for their current plan.

Violations of This Policy

If Ravalli Broadband determines that your use of the Service violates this policy:

  • Action Taken: We may suspend or terminate your account without prior notice. Additional legal or technical actions may also be taken, as deemed necessary.

  • Investigation: Ravalli Broadband may investigate suspected violations and cooperate with law enforcement as required.

  • Indemnification: Customers agree to indemnify and hold Ravalli Broadband harmless against claims arising from violations of this policy.

Copyright and DMCA Compliance

Ravalli Broadband complies with the Digital Millennium Copyright Act (DMCA). Customers must not use the Service to infringe on copyrights. If you believe your work has been infringed, you may file a DMCA notice with us at:

A $250 processing fee applies to each DMCA notice.

If you believe content was removed in error, you may submit a counter-notification. Both notifications and counter-notifications must meet the requirements outlined in the DMCA.

Final Provisions

Ravalli Broadband reserves the right to update, enforce, or waive this policy at its discretion. Any invalid or unenforceable provision of this policy will be interpreted in line with applicable law, with the remaining provisions remaining in full effect.
