Ravalli Broadband, LLC

PLEASE READ THIS ENTIRE AGREEMENT CAREFULLY.
This agreement between Ravalli Broadband, LLC ("Ravalli Broadband") and you, the customer ("Customer"), consists of this document and the Service Order (collectively, the "Agreement"). By using the services or equipment provided by Ravalli Broadband, you agree to be bound by the terms outlined in this Agreement.
This document defines our obligations to you, and your responsibilities in using the services and equipment provided by Ravalli Broadband.
1. Acceptance
You acknowledge and accept this Agreement through any of the following actions:
Providing a written or electronic signature on a Service Order.
Verbally ordering service and accepting this Agreement over the phone.
Activating or using internet service provided by Ravalli Broadband.
Paying an invoice from Ravalli Broadband.
Utilizing the Ravalli Broadband customer portal for one-time or recurring payments.
2. Fees and Payments
Ravalli Broadband does not charge late fees or reconnect fees. However, if payment is not made, the following policies apply:
30 Days Late: Service speed will be reduced to 5 Mbps until the outstanding balance is paid.
60 Days Late: Service will be disconnected.
To restore service after disconnection, the Customer must pay all outstanding balances. No reconnect fees will be charged.
3. Term
The Agreement begins on the date specified in the Service Order or upon service activation, whichever is later, and is month-to-month unless otherwise stated.
Either party may terminate the Agreement with 30 days' prior written notice.
4. Installation
Customers must be at least 18 years old and own or have the property owner’s permission to make modifications required for service installation.
Any custom installation requests (e.g., cabling through walls or under carpets) may incur additional charges.
5. Equipment Ownership and Maintenance
Customer Ownership: Customers own all equipment installed as part of their service.
Maintenance: Ravalli Broadband will maintain customer-owned equipment for as long as service is active.
Service Cancellation: Upon service cancellation, customers may:
Retain the equipment, or
Return the equipment to Ravalli Broadband in lieu of the final bill payment.
6. De-installation
Customers may remove and retain their equipment upon service cancellation. If the customer opts to return the equipment as payment for their final bill, it must be returned in good condition within 15 days.
7. Jurisdiction
This Agreement is governed by the laws of the State of Montana, and disputes shall be resolved in the courts of Ravalli County.
8. Acceptable Use
You agree to comply with all local, state, and federal laws when using the service.
Ravalli Broadband strongly recommends:
Using firewalls and antivirus software on devices connected to the network.
Configuring home or office Wi-Fi networks with strong encryption to prevent unauthorized access.
9. Prohibited and Excessive Use
You may not use the service for any unlawful or disruptive purposes, including but not limited to:
Attempting to gain unauthorized access to accounts, systems, or networks.
Engaging in activities that overload or impair the network, including flooding, mail-bombing, or denial-of-service attacks.
Distributing spam, viruses, or other harmful software.
Using the service to victimize, harass, or degrade others.
Reselling or leasing the service to third parties without written permission.
Ravalli Broadband reserves the right to monitor, restrict, or terminate service for violations of this policy.
10. Service Availability and Speeds
Ravalli Broadband strives to provide consistent internet speeds and service reliability. However, speeds may vary due to network conditions or external factors beyond our control. Service interruptions may occur during routine maintenance or unforeseen events, such as extreme weather or equipment failure.
11. Network Maintenance
Network maintenance is conducted daily between 1:00 AM and 5:00 AM (local time). During these hours, service may be temporarily unavailable without prior notice.
12. Content
Customers are responsible for all content accessed, transmitted, or shared using the service. Ravalli Broadband is not liable for third-party content or actions. Customers must respect intellectual property rights and may not reproduce or distribute copyrighted material without proper authorization.
13. Privacy
Ravalli Broadband does not monitor or sell customer browsing data.
Personal information is only collected as necessary for service provisioning, billing, and support.
Customer data will only be disclosed to third parties as required by law or as necessary to fulfill service obligations.
14. Suspension or Termination
Ravalli Broadband may suspend or terminate service without notice if:
Payments are overdue by 60 days.
The service is used fraudulently or unlawfully.
Network integrity or other customers are adversely affected by your use of the service.
15. Limitation of Liability
Ravalli Broadband is not liable for:
Service interruptions or speed variations.
Equipment damage caused by external factors, such as severe weather or power surges.
Indirect, special, or consequential damages arising from the use of the service.
16. General
This Agreement constitutes the entire understanding between Ravalli Broadband and the Customer. Changes to this Agreement will be posted on the Ravalli Broadband website at https://www.ravallibroadband.net and are effective immediately upon posting.
17. Severability
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.
